The attorneys in our Labor and Employment practice group handle a wide variety of matters in all major areas of labor relations, employee benefits, immigration and employment law. Our clients receive our advice and representation in connection with administrative proceedings, including those involving the Equal Employment Opportunity Commission ("EEOC"), the National Labor Relations Board ("NLRB"), the Immigration and Naturalization Service ("INS"), the Occupational Safety and Health Administration ("OSHA"), the U.S. Department of Labor, Office of Federal Contract Compliance Programs ("OFCCP") and state fair employment agencies. We conduct EEO and wage and hour compliance audits as well as internal investigations involving sexual harassment and other workplace complaints. In addition, we regularly advise employers with respect to employment contracts, confidentiality and noncompetition agreements, immigration issues and other employment-related matters. We assist employers in the drafting and implementation of affirmative action plans under Executive Order 11246, OSHA safety plans, and employee manuals and policies, including those affecting equal employment opportunity, mandatory arbitration and drug and alcohol use and testing.
We handle various claims of statutory employment discrimination, wage and hour violations, wrongful discharge, breach of employment contract, breach of confidentiality and noncompetition agreements and employment torts such as tortious interference with contract, intentional infliction of emotional distress, invasion of privacy and defamation.
The lawyers in our Labor and Employment practice group are also involved in all aspects of a traditional labor relations practice, including union organizing campaigns, labor contract negotiations and unfair labor practice and representation cases before the NLRB. We represent employers in labor arbitrations involving a broad range of disputes arising under collective bargaining agreements.
We routinely advise large and small employers on compliance with federal, state and local employment-related laws, and we provide status updates on proposed legislation and regulations.
