Litigation

The trial lawyers of The Travis Law Firm offer clients substantial experience at every stage of the resolution of a dispute by litigation from the most preliminary of case analyses, through preliminary proceedings and discovery activities, to the trial of a lawsuit before a jury and a judge, and on to the appellate process, when necessary. Our trial lawyers also bring significant experience to the processes of mediation and arbitration as alternative means for resolving controversies.

Our lawyers’ dockets contain not only multi-million dollar lawsuits, but also smaller cases involving a wide variety of claims. Although most of our Firm’s trial lawyers consider themselves equipped to handle lawsuits in diverse industries and regulatory frameworks, many of them have developed individual specialized expertise.

The following information describes specialized litigation areas in which the Firm’s trial lawyers have had substantial experience.

Appellate Practice

The Firm handles appeals and mandamus proceedings arising from cases that have been prosecuted or defended by our firm as well as the trial lawyers of other firms. Our appellate section forms an indispensable element of the Firm’s trial practice, not only for purposes of appealing or defending court decisions, but in the course of summary proceedings, trials and the post-judgment process.

Commercial and Civil Litigation

This Firm has considerable experience in handling complex commercial cases. Experience in this area includes suits involving breach of contract, breach of warranties, deceptive trade practices act violations, fraud, lender liability, oil and gas matters, partnership disputes, shareholder actions, securities fraud, and wrongful foreclosure. When handling complex litigation, the firm attempts first to establish an objective and theme for the case and then use them to work toward the objective as quickly and reasonably as possible. In preparing cases, negotiating settlements, and at any time when special expertise may prove advantageous to clients, our trial lawyers work in concert with other The Travis Law Firm attorneys who concentrate their practices outside litigation. We also have a strong commitment to the use of mediation and other alternative dispute resolution methods to assist in the early and economical resolution of disputes (see other summary areas).

Creditors' Rights

The Travis Law Firm’s creditors’ rights practice encompasses all facets of representing creditors from routine collections to complex lender liability litigation. Our involvement is aimed not only at obtaining the optimal judgment for our client, but also at effectuating a timely recovery of all money and other relief awarded.

Employment Litigation

Trial lawyers at The Travis Law Firm, P.C. represent large and small employers in the defense of employment and ERISA litigation in federal and state courts, along with the trial of NLRB and OSHA administrative proceedings and labor arbitration cases. Our trial lawyers have a wide range of experience in defending virtually every type of employment and employee benefits claim under federal and state legislation, as well as common law employment claims for wrongful discharge, breach of employment contract, intentional infliction of emotional distress, and defamation. Our lawyers in this practice area also routinely counsel employers on a variety of preventive measures designed to avoid litigation of employment disputes.

Environmental Litigation and Toxic Tort

The Travis Law Firm represents defendants in environmental and toxic tort litigation involving allegations of personal injury, damage to property, and financial loss. The Firm’s experience in this area includes cases alleging exposure to toxic substances from Super Fund clean-up sites and in the workplace, as well as cases alleging pollution to land by oil and gas operations. Firm lawyers have also defended companies in toxic tort cases involving alleged exposure to a wide variety of substances including hard metals; various petrochemicals such as benzene; hydrofluoric acid; vinyl chloride; and formaldehyde. In addition, our attorneys have experience in asbestos cases and silicosis cases. In 2000, Firm lawyers successfully defended a client in a mixed dust case involving 801 plaintiffs.

Real Estate Litigation

The Firm’s lawyers also have extensive experience in real estate title litigation, construction liens, foreclosures and evictions, as well as restrictive covenant disputes, representing either the individual owner or the homeowners association.

The Firm’s approach to representing homeowners associations emphasizes a "good neighbor" policy, by encouraging both sides to resolve their disputes with an eye toward their long-term relationship as neighbors, rather than simply obtaining the maximum possible recovery. Many clients welcome this as a fresh approach which minimizes both animosity and attorney fees.

Tort Litigation

The firm handles a wide range of tort cases in the personal injury area including professional negligence (architects and engineers E&O as well as legal and medical malpractice), toxic tort, premises liability and products liability defense for large self-insured companies as well as for insurance companies. Representative cases include the defense of elevator manufacturers, farm equipment owners and operators, building contractors, oil field operators, chemical manufacturers, as well as department store, motel and apartment complex owners. The Travis Law Firm also represents health care providers in medical malpractice actions and employers in sexual discrimination, wrongful discharge, and other employment related claims. Attorneys at the firm have had extensive experience in prosecuting and defending medical malpractice claims. They have represented and successfully defended doctors, dentists, orthodontists, hospitals and other health care organizations, obtaining in most cases dismissals or non-suits The Firm’s support facilities for large tort cases include paralegals, and the resources to establish, maintain and use computerized databases and high speed document scanning equipment.
